Mel Taylor, of Green Lane Trust Solutions, says it is becoming increasingly important to have the correct legal documentation to protect yourself and your loved ones and lasting powers of attorney enable you to appoint somebody to look after your property and financial affairs, and health and welfare, if you are unable to do so in the future.
Property and financial affairs
He adds: “Having a lasting power of attorney for property and financial affairs is as important, if not more so, as having an up to date will.
“This lasting power of attorney allows you to appoint someone to manage your financial affairs when you are unable to.
“This could be in the event of illness or accident, and so a lasting power of attorney is not just for the elderly to consider. Anyone can be involved in an accident at any time. “Without LPA in place the court will decide who to appoint as a deputy.
“This process takes a long time, and during it all the assets are frozen which could cause major issues in a family.
“This could be a particular problem if the main income earner is involved in an accident. If there is a mortgage in place, and income and savings in their own bank accounts, and the assets get frozen how would the spouse/children cope?”
Health and welfare
Mr Taylor says a lasting power of attorney for health and welfare is required when a person wishes attorneys to make decisions with regard to consenting or refusing medical treatment, deciding on the level of care they require, and arranging what the person will wear, and eat, and what social activities and holidays they will undertake.
Mr Taylor said: “Some regard this LPA as not so important as the property and financial affairs LPA, however if you require long term care either now or in the future, then this could be extremely important as many residential homes will not accept residents without a registered Health and Welfare LPA.”
