Appeal threat to Wealden Local Plan

Wealden District Council’s Local Plan could be back in the melting pot.

A claim for a Judicial Review of the plan was thrown out in the High Court last month (story here) but now the applicants are hoping they will be able to launch an appeal.

They are seeking “leave to appeal” from the courts.

If granted, the case would go to the Appeal Court.

Cllr Ann Newton, chairman of Wealden District Council’s planning and development committee, said: “We are obviously very disappointed that, after the High Court gave such a clear decision in favour of Wealden’s Core Strategy, a group of wealthy landowners continues to use all opportunities available to it to try to tear up our local plan in order to allow more housing to be built in the north of the District.

“It will once again put further demand on already stretched officer time. In the end our council tax payers are the ones who lose out in this exhausting legal process.”
